Unicorn poop toymaker settles with BMG over Black Eyed Peas’ “My Humps”

The band sued MGA Entertainment after a parody of the song appeared in a TV ad earlier this year.

Toymaker MGA Entertainment has settled with BMG in a copyright lawsuit over MGA's parody of Black Eyed Peas' 2005 hit, "My Humps," used in a television commercial. The amount of the settlement has not been revealed.

U.S. District Judge Edgardo Ramos terminated the case on Monday (October 2). In court documents seen by The FADER, he wrote, "The Court having been advised that the parties have reached a settlement in principle, it is ORDERED that the above-entitled action be and hereby is discontinued, without costs to either party, subject to reopening should the settlement not be consummated within thirty (30) days of the date hereof."

MGA used their version of the song, "My Poops," to promote Poopsie Slime Surprise, a brand of glittery "unicorn poop" slime. The music giant sued MGA back in January, alleging it infringes on the song's intellectual property. BMG owns 75% of the "My Humps" copyright.

Had the case gone to court, MGA could have used the reasoning that the song is a parody and therefore, doesn't infringe on the copyright.
