When Dr. Luke's Kemosabe records rescinded approval for Kesha's Billboard Awards performance earlier this week, it cited "a media report" suggesting that the singer would use the situation to address her ongoing legal dispute with Dr. Luke. On Instagram, Kesha refuted the report, noting that her performance "never had anything at all to do with Dr. Luke. I was never going to use a picture of him, speak of him or allude to my legal situation in any way."
Kemosabe now appears to believe her, and the label reversed its position once again: the singer will now be performing on Sunday. "Kesha’s performance at the Billboard Music Awards was always approved, in good faith," the label said in a statement. "Approval was only suspended when Kemosabe learned Kesha was to use the performance as a platform to discuss the litigation. Now that Kemosabe has obtained assurances, that it is relying upon, from Kesha, her representatives and Dick Clark productions that neither Kesha nor her supporters will use the performance as such a platform, the approval has been restored."
The singer previewed her Billboard Awards performance last night at a show with Ben Folds.
Reps for Kesha, Dr. Luke, and the Billboard Music Awards did not immediately return a request for comment.
Update (May 19, 3:49 p.m.): A rep for dick clark productions, the producers of the BBMAs, emailed the following statement:
"We are pleased that Kesha and Kemosabe Records have reached an agreement and very much look forward to having Kesha perform on the Billboard Music Awards this Sunday night on ABC."
