Kerry Lathan, the man Nipsey Hussle was buying clothes for during the fatal altercation at Marathon Clothing, is due to be released from jail. A representative from the Los Angeles Superior Court tells TMZ that the Department of Corrections and Rehabilitation has dropped its petition to revoke Lathan's parole, and that Lathan could be released as soon as this afternoon.

Lathan had just been released from a twenty year sentence upon connecting with Hussle, and was shot and injured during the attack. Last week, he was arrested again, as Hussle's gang ties violated the stipulations of his parole.
