The Los Angeles City Attorney’s office decided against filing because there was “no reasonable likelihood of conviction,” a spokesman told Rolling Stone.

The City of Lost Angeles will not be filing charges against Kanye West for allegedly punching a fan in January, Rolling Stone reports. “After a thorough and careful review of all the evidence, our office is declining to file based on no reasonable likelihood of conviction,” Rob Wilcox, a spokesman for L.A. City Attorney Mike Feuer, told the magazine. The FADER has reached out to Feuer’s office and to a representative of Kanye West for further comment.

The incident in question allegedly occurred when a male fan approached Ye outside SoHo Warehouse, a members-only club in downtown L.A., in the early morning hours of January 13, 2022. A video posted by TMZ that afternoon appears to show West shouting at a woman who seems to be attempting to calm him down while his alleged victim lies on the ground. The LAPD investigated Ye for criminal battery following the reported altercation.

Had Ye been charged with and convicted of misdemeanor battery, he could have faced prison time. He pleaded no contest to a similar charge in 2013 after assaulting a paparazzi photographer at Los Angeles International Airport, a crime for which he was sentenced to two years of probation as well as community service and anger management classes.
